Members of the City Council,

To declare city property surplus, not only must the council make supportive findings, it must vote that the subject land is surplus "and is not necessary for the agencys use.”

Given the 100 percent usage of Lots 1, 2, and 3 on most any weekday and the need for the parking therein to support commerce, services, and the Santa Cruz and Oak Grove avenue business districts, it hardly can be said the property in question is not necessary for use by the city, its residents, and its visitors.

Tonight’s resolution lacks factual support for adoption. Please do not approve it.
